The End-User License Agreement under which you use IPTV Stalker and any license you buy.
This End-User License Agreement (the "EULA") governs your use of the IPTV Stalker application (the "Licensed Application") and the iptvstalker.app website, published by Pokharel Software Services Inc. By downloading, installing, or using the Licensed Application, you (the "End-User") agree to this EULA. References below to "we", "us", or "IPTV Stalker" mean Pokharel Software Services Inc.
Where you obtained the Licensed Application through the Apple App Store, this EULA applies in addition to, and does not conflict with, Apple's Apple Media Services Terms and Conditions in effect as of the date you accept this EULA. The sections below follow the minimum terms Apple requires of a developer's EULA.
You and we acknowledge that this EULA is concluded between you and us only, and not with Apple, and that we, not Apple, are solely responsible for the Licensed Application and its content. This EULA does not provide usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions.
We grant you a personal, non-transferable, non-exclusive license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
You may not sub-license, resell, rent, lease, lend, or otherwise transfer the Licensed Application or your license. You are solely responsible for ensuring that you have the necessary rights, subscriptions, or authorisations to access any source, device, or service you configure the app to talk to. You agree not to use the app to:
Violating this section terminates your license immediately and without refund.
We are solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA or as required under applicable law. You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
The Licensed Application is provided on an "as is" basis. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
We do not guarantee uninterrupted availability, and we are not responsible for the availability or behaviour of any third-party source, device, or network you connect the app to.
You and we acknowledge that we, not Apple, are responsible for addressing any claims of yours or any third party relating to the Licensed Application or your possession and/or use of it, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA does not limit our liability to you beyond what is permitted by applicable law.
You and we acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using the Licensed Application — for example, the terms of any IPTV source, Stalker portal, or playlist provider you connect to, and your wireless data service agreement, which you must not violate when streaming through the app.
You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of its terms and conditions, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
Licenses are sold, billed, and renewed through the store or channel you obtained the app from, under that provider's terms and account settings. Payment is collected by that provider; we do not collect or store your payment details. Refunds and cancellations are processed by that provider under its policies. You may cancel a subscription at any time through that provider's account settings; the license then remains active until the end of the period already paid for, and the unused portion is not refunded. Each platform is licensed and billed separately; a license obtained on one platform does not extend to any other.
We ship updates from time to time. While a license remains valid, you receive all updates we publish for the relevant platform. We may discontinue support for an older OS version at our discretion.
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to this EULA or the Licensed Application is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of data, loss of profits, or interruption of service.
You may stop using the Licensed Application at any time. We may suspend or terminate your license if you breach this EULA, in which case any unused portion of the license is forfeit.
Your use of the Licensed Application is also governed by our Privacy Policy, which is incorporated into this EULA by reference.
This EULA is governed by the laws of the jurisdiction in which Pokharel Software Services Inc. is established, without regard to conflict-of-laws principles. Any dispute that cannot be resolved by good-faith correspondence will be handled by the courts of that jurisdiction.
We may revise this EULA occasionally. Material changes will be highlighted at the top of this page. Continued use of the Licensed Application after the change date constitutes acceptance.
